(also referred to as “CTMA”, “CTMA Mexico” “Company”, “we” or “our” ), with domicile in Mexico, website: www.ctma.mx, is responsible for the correct treatment and safeguarding of personal data and/or sensitive personal data, which it uses to comply with the obligations it has undertaken with its customers, patients or vendors through agreements and in the case of patients for the processing of their information, as well as those users who register on our website or in order to request information on the clinical research services and/or products that CTMA offers, about this respect we inform you of the following,

PURPOSES FOR WHICH WE WILL USE YOUR PERSONAL DATA

TRANSFER OF PERSONAL DATA

CTMA will not market your personal data to third parties and the data provided will be collected for the purpose of providing you with our services and to carry out the purposes described in this Privacy Policy. Nevertheless, you are hereby informed that the personal data collected may be transferred to laboratories exclusively to support the clinical diagnosis of patients. You may also transfer the personal data to third parties either to follow up treatment with doctors or to follow up your medication or to sponsor the test, entities of the same interest group of CTMA or those with which it has concluded contracts for the provision of services or similar, and/or third parties, national or foreign, solely for the purpose of complying with the purposes for which such personal data have been provided, without CTMA being responsible in any way for such issues or follow-ups.

ARCO RIGHTS (Access, Rectification, Cancellation and Opposition) OF THE CONSENT FOR THE TREATMENT OF YOUR DATA

You have the right to know what personal data we have about you, what we use it for and the conditions of use we give to it (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Correction); that we remove it from our records or databases when you consider that it is not being used in accordance with the principles, duties and obligations provided for in the regulations (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

In order to know the procedure and requirements for the exercise of the ARCO rights, you may contact the person in charge of the personal data, who will process the requests for the exercise of these rights and will attend to any doubt you may have regarding the treatment of your information.

The request must contain and be accompanied by the following:

  1. The name of the owner and address or other means of communicating the response to your request; 
  2. The documents proving the identity or, where appropriate, the legal representation of the owner;
  3. A clear and precise description of the personal data with respect to which you are seeking to exercise any of the aforementioned rights;
  4. Any other element or document that facilitates the location of the personal data and
  5. An indication of the changes to be made and the documentation supporting your request.

In the event that any of the holder’s personal data is inaccurate or incomplete, the holder must not only indicate the above, but also indicate the changes to be made and provide the necessary documentation to support the request.

CTMA reserves the right not to cancel the records of the aforementioned data in the cases specifically indicated by the Federal Law on the Protection of Personal Data in the Possession of Individuals, its Regulations and other applicable legal provisions.

CTMA will have a maximum period of 20 working days to inform you at your home or by any other means indicated in your request, of the origin of the exercise of ARCO rights, which may be extended once only in the event of justified cause.

In the case of requests for access to personal data, the delivery will proceed after accreditation of the identity of the applicant and owner, for which CTMA will deliver the acknowledgement of receipt to the request. If the request is appropriate, ARCO rights will be enforced within 15 working days from the date of response. This period may be extended only once for justified reasons. If, after the term indicated in the Law and other applicable legal provisions, CTMA does not respond to your request or the owner does not agree with the response, you may file a data protection request with the National Institute of Transparency, Access to Information and Personal Data Protection -INAI-.

REVOCATION OF CONSENT FOR USING YOUR PERSONAL DATA

You can revoke your consent to the processing of your personal data. Please note, however, that we may not be able to comply with your request or terminate use immediately in all cases, as we may be required by law to continue processing your personal data. You should also consider that for the purposes related to providing you with our services and/or products, the revocation of your consent will imply that we cannot continue to maintain a relationship with you.
